We have all heard of the expression, “If a tree falls in a forest, and there’s no one around to hear it, does it make a sound?” Apparently, that is a debatable issue. But what about when a tree falls on a worker while he’s on a bathroom break (in a Porta-Potty)? Is the resulting injury compensable?
